Terms of Service

If your organization has a separate signed agreement with AIM Intelligence, that agreement governs your use of Stinger and prevails over these Terms.

These Terms of Service (the “Terms”) govern your access to and use of Stinger, an AI red-teaming platform provided by AIM Intelligence Co., Ltd. (“AIM Intelligence”, “we”, “us”). By creating an account, signing an order form, or using the platform (the “Service”), you (the “Customer”) agree to these Terms. If you are accepting on behalf of an organization, you represent that you are authorized to bind it.

1. What the Service does

Stinger conducts adversarial security testing of AI systems — including jailbreak, prompt-injection, tool-call abuse, and related techniques — to evaluate the robustness of guardrails before deployment. You acknowledge that the Service is an offensive-security diagnostic tool by design: it deliberately attempts to bypass controls on the systems you direct it against (each, a “Target”), and may cause the Target to produce unexpected output, incur usage cost, or behave in ways its operator did not intend. You accept these characteristics as inherent to authorized red-team testing.

2. Authorized use only

Your right to use the Service is limited to Targets that you own or operate, or for which you hold current, written authorization to conduct adversarial testing. You represent and warrant that, for every Target you designate, you have the authority to permit — and you hereby authorize us and the Service to perform — adversarial testing against that Target’s AI models, endpoints, agents, and applications, and that such testing is within the scope of that authorization.

You are solely responsible for verifying authorization and scope before each engagement. Using the Service against any system outside this authorized scope is a breach of these Terms and of the license granted to you, and is grounds for immediate suspension.

3. Consent and assumption of risk

Because adversarial testing probes, scans, and attempts to circumvent the controls of a Target, such activity could — absent authorization — violate computer-misuse, contract, or other law. By directing the Service at a Target, you confirm that you have the necessary consent for that activity and you assume all risk for any effect of the testing on the Target, including disruption, unexpected content, or cost. You waive, and will not assert against us, any claim arising from testing you initiated.

4. Acceptable use

Your use is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. We have no obligation to pre-approve or monitor your activity, but we may suspend or terminate access on suspected illegal, harmful, or out-of-scope use.

5. Accounts and security

You are responsible for safeguarding credentials and API keys, for all activity under your account, and for the acts and omissions of your users, agents, and contractors as if they were your own. Notify us promptly of any unauthorized use.

6. Intellectual property

We retain all rights in the Service, including the attack engine, strategies, prompts, judging models, and underlying technology. You own your data and the diagnostic reports and findings generated for you (the “Findings”), and may use them internally and with your auditors and regulators. You grant us a limited license to process your data to deliver the Service, and a license to use de-identified, aggregated usage data to operate and improve the platform. Any feedback you provide may be used by us without restriction.

7. Findings are diagnostic, not a guarantee

Findings, scores, and breach classifications are produced by automated and model-based analysis and may be incomplete or inaccurate. The Service does not protect against, or identify, all vulnerabilities — known or unknown — and a passing result is not a warranty of security. You must not rely on Findings as the sole basis for any security or compliance decision.

8. Warranty disclaimer

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to results, accuracy, or effectiveness, to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability arising out of or relating to the Service will not exceed the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. These limits do not apply to your indemnification obligations or to liability that cannot be limited by law.

10. Indemnification

You will defend, indemnify, and hold harmless AIM Intelligence from any claim, loss, or liability arising out of (a) your use of the Service, (b) your data or your Targets, (c) any testing of a Target you were not authorized to test or that exceeded your authorized scope, and (d) your breach of these Terms or violation of law — including claims arising from the acts of your users, agents, and contractors.

11. Export control and sanctions

The Service is an offensive-security technology and may be subject to export-control and sanctions laws, including those of the Republic of Korea, the United States (EAR/OFAC), and the European Union. You represent that you are not located in, or a national of, an embargoed or restricted jurisdiction, and are not on any restricted-party or sanctioned-party list. You will not use the Service in connection with the development of nuclear, chemical, or biological weapons or missile systems, or for any other prohibited end-use, and you will comply with all laws governing security-testing software in every jurisdiction where a Target is tested.

12. Term, suspension, and termination

These Terms apply while you use the Service. We may suspend or terminate access for breach, suspected illegality, or risk to the Service or third parties. Provisions that by their nature should survive — including IP, disclaimers, liability limits, indemnification, and export terms — survive termination.

13. Trials and proofs of concept

Trial, beta, and proof-of-concept access is provided for evaluation only, may be time-limited, and is offered with no warranties or service commitments; your sole remedy for dissatisfaction is to stop using it.

14. Governing law

These Terms are governed by the laws of the Republic of Korea, and the courts of Seoul have exclusive jurisdiction, unless a signed agreement between us specifies otherwise.
